Construction Site Sanitation Requirements: What Every Contractor Needs to Know

Mar 10, 2026 | Uncategorized

In the world of construction, “site prep” usually brings to mind heavy machinery, perimeter fencing, and clearing land. But there is one essential piece of infrastructure that can halt your project faster than a broken excavator: sanitation.

Inadequate or unsanitary restroom facilities aren’t just a blow to crew morale—they are a direct violation of federal and state laws. At M&A Rentals, we help Lubbock contractors navigate these regulations every day.

Here is a breakdown of the sanitation requirements you must meet to stay compliant and keep your project moving.

1. The Numbers: How Many Units Do You Need?

The Occupational Safety and Health Administration (OSHA) is very specific about the ratio of workers to toilets. Under standard 29 CFR 1926.51(c), the minimum requirements are as follows:

Number of Workers Minimum Number of Facilities
20 or Fewer 1 Toilet
20 to 199 1 Toilet Seat & 1 Urinal per 40 workers
200 or More 1 Toilet Seat & 1 Urinal per 50 workers

The “ANSI” Gold Standard: While OSHA sets the legal floor, the American National Standards Institute (ANSI) recommends a higher standard for productivity: 1 unit per 10 workers. > Pro Tip: If your site has a mixed-gender crew, Texas law and OSHA guidelines generally require separate facilities for men and women to ensure privacy and dignity, unless the room can be locked from the inside and is intended for one person at a time.

2. Accessibility: The “10-Minute” Rule

Providing a toilet is only half the battle; your workers have to be able to reach it. OSHA interprets “available” as having prompt access.

  • Distance: Facilities should be within a 10-minute walk of the work area. On large, sprawling sites, this means you may need to distribute units across the perimeter rather than clustering them in one spot.

  • High-Rise Sites: For vertical construction, units should be available every few floors to prevent workers from losing 20+ minutes of productivity every time they need a break.

3. Handwashing and Hygiene

Sanitation doesn’t stop at the toilet. OSHA requires that “lavatories shall be made available in all places of employment.”

For construction sites, this means providing:

  • Running Water or Sanitizer: If soap and water aren’t feasible, you must provide hand sanitizer with at least 60% alcohol content.

  • The M&A Strategy: We always recommend pairing your portable toilets with standalone handwash stations. It significantly reduces the spread of illness on-site and keeps your crew healthy and on the job.

4. The “Sanitary Condition” Requirement

A portable toilet only counts toward your legal total if it is usable and sanitary. An unserviced, overflowing, or broken unit is viewed by inspectors as if it doesn’t exist at all.

To stay compliant, your units must be:

  • Vented: Properly ventilated to reduce odors.

  • Maintained: Restocked with toilet paper and cleaned at least once a week (more often for high-traffic sites).

  • Lit: If you have crews working night shifts, the path to the restroom and the unit itself must be adequately lit.
